It is an integrated IT system launched in Poland, whose main purpose is to collect and manage information related to waste management and products and packaging introduced to the market. The BDO system was introduced to seal the waste management system, increase control over waste flow, and enable more effective monitoring of entrepreneurs’ obligations.

Definition and Purpose of the BDO System

The BDO system performs several key functions:

• Register of Entities: Contains information about companies introducing products, packaged products, managing waste (e.g., producers, collectors, processors).
• Waste Record: Allows keeping electronic records of waste generated, collected, and processed.
• Reporting: Used for submitting annual reports on, among others, waste produced, packaging introduced, used electrical and electronic equipment.
• Control and Supervision: Provides control authorities (e.g., Environmental Protection Inspection) with tools to monitor compliance with regulations.

The purpose of BDO is, among other things, to combat the grey area in waste management, improve recycling rates, and ensure transparency in waste flow.

Who is Required to Register in BDO?

The obligation to register in the BDO Register applies to a wide range of entrepreneurs. In the context of the oil and lubricants industry, registration applies to, among others:

• Waste Producers: Any entity (company, workshop, production plant) that generates waste through its activities (including used oils and packaging from them), if it exceeds certain quantitative or qualitative thresholds (for hazardous waste, thresholds are low or none at all).
• Entities Introducing Packaged Products: Companies that introduce packaged products to the Polish market (e.g., oils, lubricants in bottles, barrels, cartridges).
• Entities Introducing Lubricants or Oils to the Market: Entities introducing lubricating oils (engine, gear, industrial) are subject to the product fee and the obligation to ensure the recovery and recycling of post-consumer waste.
• Importers and Manufacturers of Packaging.
• Waste Transporters (on behalf or own).
• Sellers and Intermediaries in Waste Trade.

There are certain exemptions from the registration obligation, e.g., for municipal waste producers or companies producing small amounts of certain non-hazardous waste. It is always necessary to verify thoroughly whether a given activity is subject to the registration obligation.

Basic Obligations of Companies Registered in BDO

After obtaining the BDO registration number, entrepreneurs have the following obligations:

1. Keeping Waste Records: In electronic form within the BDO system. This includes, among others, Waste Record Cards (KEO) and Waste Transfer Cards (KPO). The KPO is a document confirming the legal transfer of waste to an authorized recipient.
2. Preparing and Submitting Annual Reports: Concerning, among others, the amounts and types of waste generated, mass of packaging introduced, achieved levels of recovery and recycling. Reports are submitted electronically via the BDO system to the provincial marshal.
3. Placing the BDO Registration Number on Documents: E.g., on invoices, receipts, KPO.

How BDO Relates to the Management of Used Oils

• Producers of Used Oils (e.g., workshops, industrial plants) must keep their records in the BDO and transfer them only to entities with appropriate permits, documenting this with KPO.
• Companies Collecting and Processing Waste Oils must also be registered in BDO and keep detailed records.
• Entities Introducing Lubricating Oils to the Market have the obligation to settle the product fee and achieve recovery and recycling levels of oil waste, which is also reported in BDO.

Consequences of Non-Registration or Non-Compliance with Obligations

Failure to comply with obligations related to BDO can result in serious financial consequences:

• Administrative financial penalties (ranging from hundreds to over a million zlotys).
• Fines.
• In extreme cases, even arrest.

Lack of a BDO number can also prevent the legal transfer of waste, as waste recipients are required to verify the BDO number of the transferor.
