1. Who is the Administrator of Your personal data?

The administrator of the personal data you provided is Mobipol Trading and Service Company Jerzy Kruczek Antoni Kalina General Partnership
headquartered in Wrocław, hereinafter referred to as Mobipol.

2. What personal data are we talking about?

This concerns personal data collected as part of your use of our
services (sales, technical consulting, newsletter). In this regard, we need the following data from you: first name, last name, possibly the name
of the company, company address, and NIP (if the purchase is made by a company). Additionally, for contact purposes: email address and / or phone number.

3. What is the purpose of processing personal data

  • in the case of a concluded sales agreement, personal data will be processed to fulfill the provisions of the contract
  • the legal basis for processing personal data in this case is art. 6 sec.1 letter b), which means processing is necessary for the execution of the contract and art. 6 sec.1 letter f), which refers to the legitimate interest of the Administrator;
  • personal data may be processed for sending commercial information, including marketing information regarding our own products and services electronically or / and by phone.
  • the legal basis for processing personal data for marketing purposes is art. 6, sec. 1 letter a), which means the consent of the person whose data concerns, and art. 6 sec.1 letter f), which means the legitimate interest of the Administrator;

4. Are personal data processed or will they be processed in any other way?

As a business entity conducting trading and service activities, we care for
the confidentiality of your data. Due to the necessity of ensuring proper organization of our company – such as in the area of IT infrastructure or ongoing issues regarding our activities as an entrepreneur – your personal data may be transferred, i.e., disclosed or made available, to the following categories of recipients:

  • other business entities cooperating with Mobipol in providing services;
  • service providers supplying Mobipol with technological, IT, and organizational solutions enabling Mobipol to provide services and manage our company (in particular, this refers to providers of teleinformation services, courier and
    postal companies)
  • providers of legal and advisory services and those supporting Mobipol in pursuing its claims (e.g., law firms and debt collection companies);
  • the legal basis for processing personal data in this case is art. 6 sec.1 letter b), which means processing is necessary for the execution of the contract and art. 6 sec.1 letter f), which means the legitimate interest of the Administrator;

We would like to inform you that entities that process personal data on behalf of Mobipol do so based on and pursuant to an entrustment agreement (in accordance with art. 28 GDPR), or based on statements of confidentiality.

5. Where do we have your personal data from?

We received your personal data from you through the voluntary creation of your account on our website www.mobiloleje.pl or by filling out the form necessary for making purchases on the mentioned site.

6. For how long are personal data processed?

We inform you that personal data will be processed for the period necessary to achieve the purposes mentioned in point 3:

  • as for fulfilling the provisions of the contract – we store your personal data for the duration of the contract, as well as after its termination in order to: – pursue claims related to the performance of the contract, – fulfill obligations arising under the law, in particular tax and accounting, – statistical and archival purposes, – but no longer than for a period of 10 years from the date of completion of the execution of the contract or until the period of limitation of claims expires;
  • for marketing purposes – we store your personal data for the duration of the contract or until you withdraw your consent or object to such processing, depending on which event occurs
  • earlier;
  • for newsletter subscription purposes –
    we store your personal data until you withdraw your consent or object to such processing, depending on which of these events occurs first.

After the expiry of the aforementioned periods, your data will be deleted or anonymized.

7. Is providing personal data mandatory?

We inform you that providing personal data is not mandatory. However, taking into account the realization of goals set in point 3, providing personal data may have a:

  • contractual character, meaning providing personal data is a requirement for the conclusion of a contract. In other words, not providing personal data will result in the inability to conclude the contract and therefore in the inability to use services and products belonging to Mobipol
  • voluntary character, but providing data is necessary to achieve the purposes related to, among other things:
  • receiving commercial information electronically or / and by phone, including marketing information regarding our company’s products and services
  • newsletters subscription,
  • participation in contests, promotions
  • participation in surveys.

8. What rights do you have?

Regarding the processing by Mobipol of your personal data – you have the right to access, rectify, and delete personal data, limit their processing, the right to data portability, and the right to object to the processing of personal data.

Furthermore, we inform you that in the case of processing personal data based on expressed consent, all consents granted for processing, as mentioned
in point 3 – can be withdrawn at any time. However, withdrawing consent does not affect the legality of processing carried out based on consent before its withdrawal.
